Terms of Use

Please read these Terms of Use ("Terms") carefully before using Kirei Paint ("the app"). By downloading, installing, or using the app, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the app.

1. Use of the App

Kirei Paint is a color-by-number painting application that allows you to paint pre-made and AI-generated artworks. You agree to use the app only for its intended purpose and in compliance with all applicable laws and regulations.

2. Age Requirement

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use the app. By using Kirei Paint, you represent and warrant that you meet this age requirement. If you are under the age of 18 (or the age of legal majority in your jurisdiction), you must have permission from a parent or legal guardian to use the app.

3. Subscriptions and Payments

• Kirei Paint offers auto-renewable subscription plans (weekly and yearly) that provide access to premium features including unlimited AI generations, all collections, unlimited hints, and watermark-free sharing.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions).
• The current subscription period cannot be canceled or refunded once activated.
• Free trial periods, if offered, will automatically convert to a paid subscription unless canceled before the trial ends. Any unused portion of a free trial will be forfeited upon purchasing a subscription.
• Prices are in local currency and may vary by region. We reserve the right to change subscription pricing; any price changes will apply to the next billing cycle after notice.

4. AI-Generated Content

The Magic feature allows you to generate images using AI based on text prompts. By using this feature, you agree to:

• Not use the AI feature to generate offensive, harmful, illegal, sexually explicit, or otherwise inappropriate content.
• Accept that AI-generated images may not always match your expectations and that results may vary.
• Understand that generated images are created for personal use within the app.
• Acknowledge that we reserve the right to review, moderate, and remove AI-generated content that violates these Terms.

5. Intellectual Property

All pre-made artworks, designs, graphics, UI elements, animations, sounds, and other app content are the property of Kirei Paint and are protected by applicable copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app and its content for personal, non-commercial purposes only.

You may share your completed paintings for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any app content without our prior written permission.

6. User Conduct

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app
• Use the app for any unlawful, fraudulent, or malicious purpose
• Attempt to bypass, disable, or circumvent any security features, subscription mechanisms, or digital rights management
• Submit harmful, offensive, or inappropriate prompts to the AI feature
• Interfere with or disrupt the app's servers, networks, or infrastructure
• Use automated systems (bots, scrapers) to access the app

7. Termination

You may stop using the app at any time by uninstalling it from your device. We reserve the right to suspend or terminate your access to the app, without prior notice, if you violate these Terms or engage in conduct that we determine to be harmful to the app, its users, or third parties. Upon termination, your license to use the app is immediately revoked. Sections relating to intellectual property, disclaimers, limitations of liability, and indemnification shall survive termination.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIREI PAINT AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to defend, indemnify, and hold harmless Kirei Paint and its developer from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the app, your violation of these Terms, or your violation of any rights of a third party.

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make changes, we will revise the "Last updated" date at the top of this page. For material changes, we may provide notice within the app. Your continued use of the app after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the app.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Turkey.

14. Notice for Apple Device Users

If you are using the app on an Apple device, the following additional terms apply:

• These Terms are between you and Kirei Paint only, not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content.
• Kirei Paint, not Apple, is solely responsible for the app, its content, maintenance, support services, and any warranties (to the extent not disclaimed).
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app (if applicable). Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims relating to the app, including product liability claims, any claim that the app fails to conform to legal requirements, and claims arising under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property infringement claims related to the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce them against you.
